When buying an apartment, you need to check both the property itself and its owner (seller). The main task is to identify circumstances that in the future may lead to the fact that your purchase and sale transaction may be invalid.

1. Look through the title and supporting documents for the apartment.

Title documents are those that are listed as grounds of law in the certificate, the statement of the Unified State Register of Law or the Unified State Register of Real Estate.

2. Check these data with the data specified in the database of The Federal Service for State Registration, Cadastre and Cartography.

3. Check the absence of encumbrances: mortgages, arrest, ban on transactions in the Federal Service for State Registration, Cadastre and Cartography database.

4. Request an up-to-date extract from the Unified State Register of Real Estate on paper.

5. Ask the owner for an extract from the household register.

6. Request technical accounting documents: a technical passport or a floor plan with an explication.

How to check the owner?

1. Be sure to request the notarized consent of the spouse if the apartment was purchased in marriage.

2. The legal capacity of the copyright holder is confirmed by certificates from the neuropsychiatric and narcological dispensaries.

3. Make sure that there are no enforcement proceedings against the owner.

4. Find out if there is any information about the bankruptcy of an individual.

5. Request the consent of the guardianship authorities.

6. Check the arrears of utility and maintenance payments.

7. Depending on the basis of the ownership right, additional checks may be required.

8. Make sure that no one's rights were infringed during privatization.

If the apartment was privatized, you need to make sure that the rights of other family members who lived in the apartment on the date of privatization were not infringed.

 This can be checked by an extended extract from the household register. If someone other than the owner was registered in the apartment on the date of privatization, it is necessary to request confirmation from the owner of the refusal of these persons to participate in privatization. Information about all persons who have received the rights to an apartment through privatization will be specified in the Privatization Agreement.
